Studio Terms & Conditions

Dynamic Pilates Studio is committed to ensure the health and wellbeing of all our studio clients. You are required to inform the studio and our instructors of any health risks, pre-existing injuries, illness, pregnancy, a medical condition or anything that may affect your exercise practice before starting a class. Dynamic Pilates Studio recommends that you seek medical advice before participating in any classes at our studio’s. Participating in any exercise at our studio, online or events is done so at the clients/member’s own risk. All new students are required to sign a liability waiver. 

INSTRUCTOR METHODS

All of our instructors will use methods in which they may ‘correct’ or adjust a client’s Dynamic Pilates Studio poses or exercise form, and as such might make physical contact. This type of instruction is in place to ensure safer practice and limit of injury to clients while exercising and has been reduced in post Covid-19 social distancing world. By taking part in a class you acknowledge that you accept this method of instruction and take part in the class at your own risk.  

SCHEDULE CHANGES

Dynamic Pilates Studio reserves the right to make changes to the class schedules, opening hours, membership pricing and instructors at any time.  

PERSONAL BELONGINGS

You are responsible for the loss, theft or breakage of any personal belongings you bring into the studio. We recommend not bringing valuable items into sessions, such as phones, jewellery, wallets or purses.  

VEHICLES

Vehicles and their contents, parked at Karrinyup shopping centre car park are left at the owners risk and we will accept no liability for loss or damage.

MEMBERSHIP AGREEMENTS

When signing up to one of our memberships, you must agree to the membership agreement detailed on the Mind Body Dynamic Pilates Studio. This agreement authorises the direct debit and lists any conditions specific to your membership package.  

NON-PAYMENT OF MEMBERSHIP

As part of the membership agreement, Dynamic Pilates Studio reserves the right to refuse entry to classes or cancel bookings if a customer’s account is in arrears and until they bring their account up to date. Dynamic Pilates will charge a $10 fee to your nominated bank/credit card if the payment is dishonoured.  

HOLD PERIODS ON MEMBERSHIPS

During your membership period, your account can be placed on hold for number of weeks and payments will be frozen during this time. these are to be done in 2 week increments. Dynamic Pilates  requires 14 business days written notice of a ‘freeze’ / on hold period – sent to info@dynamicpilatesstudio.com.au The minimum term of payments will be required regardless of any hold period chosen. The following periods are allowed for membership types: 

1 session per week or 3 month minimum contract term = 3 weeks hold period allowed
2-4 sessions per week or 6 month minimum contract term = 6 weeks hold period allowed  

All memberships are set to automatically roll over to another membership period. If you choose to terminate your membership, written (email) notification to info@dynamicpilatesstudio.com.au is required 7 business days before the membership is due to roll over or after the initial minimum term is completed to cancel the membership .

PRICING

Dynamic Pilates Studio may change these direct debit terms and/or pricing at any time by providing the customer with 30 days advance written notice of such changes.  

COMFORT GUARANTEE

You have a ‘comfort guarantee’ or ‘cooling off period’ period of 14 days commencing on the date a Contract is formed.  If you wish to utilise this period to cancel your membership, you are required to apply for cancellation via our { gabby insert process/details} We will cancel your Contract and you will be charged for 2 weeks membership fee, plus  the administration fee only ( need to dicuss this with you gabby). After the Comfort Guarantee period ends, if you wish to terminate/cancel the Contract, you must pay certain fees to us. The particular amount of fees payable varies depending upon the reason that you are terminating the Contract. Please refer to the following cancellation provisions outlined for full details in relation to your right to cancel your membership and the fees payable in those circumstances.

CANCELLATION/TERMINATION WITHIN MINIMUM TERM

You can cancel your membership prior to  the expiry of the minimum term of 3 months if you become subject to medical incapacity, if you relocate to an area not within 30 kilometres of Dynamics Pilates Studio or if we make changes to the Contract  which adversely affect you (refer to clause 17 in Synkro Wellness Centre’s T&Cs). For cancellation due to medical incapacity or relocation, you will only be permitted to cancel your membership if you produce supporting documentation to our satisfaction (in the case of medical reasons, by a qualified medical practitioner certifying that you are sick  or incapacitated from undertaking any exercise regime for  the remaining term of your membership, and in the case of relocation, by an agent or employer certifying your relocation).

If these circumstances do not apply to you, a departure fee will be charged depending on the number of weeks  left on the Contract. Please refer below. Once the 3 month initial term is complete your membership will continue on a month by month basis, 30 days written notice is required to cancel once in this period. ** need to clarify process with Mindbody/ezidebit 

CLASS SCHEDULING, CANCELLATIONS, AND LATE TERMS

Allowance of sessions on memberships do not roll over from week to week. It is the member’s responsibility to schedule their own classes using Dynamic Pilates Studio online booking system or app. Members must provide 12 hours’ notice to cancel a class. If they do not give this sufficient notice, or they do not show for a booked class the class will be debited from their weekly allowance of sessions or member package. For the safety and enjoyment of all participants and as studio policy since June 2020 (Covid re-opening) students will not be permitted to enter a class once the class has started and therefore will lose this booked class from there weekly allowance of sessions or member package. This is a strict policy, thanks for your understanding. ----- Gabby can you please confirm the ruling and wording of this.

REFUNDS

Our membership packages, class packages, casual classes and event tickets are non-refundable and non-transferable. Unused classes are not rolled over to the next period. If a customer is unsatisfied with the services provided by the Dynamic Pilates Studio or believes that they may be entitled to a refund, then Dynamic Pilates Studio requires the customer to contact us directly via

info@dynamicpilatesstudio.com.au outlining why you believe you are entitled to a refund attached any medical certificates if relevant so we are able to adequately respond to your request. Please note that a refund made under these circumstances will incur a 10% charge on the amount refunded to cover admin and any Ezidebit fees. Last updated: October 2020.


Prices and Booking
Our current prices and timetables are displayed on our website. Our prices may change, and these will be notified on the website.   
There are a set number of spaces in each class.  To attend a class, you must reserve a space. Bookings can be made online, via our website or by calling or emailing Dynamic Pilates studio.  


Cancellation Policy 
To cancel a booking, you must notify your studio at least 12 hours prior to the commencement of the class. Cancellations made with less than 12 hours’ notice will incur the full cost of the class booked.  If you know you will not be able to make a class for which you have booked, within the 12 hour cancellation window, we strongly encourage a cancellation to be made, so that another person may take your reservation on the reformer.  

Class Waitlists
If you are unable to book a spot because the class is full, register yourself on the waitlist and when a spot becomes available, you will be notified via email and automatically booked into the workout. Please ensure you check your email for your waitlist confirmation.
As a courtesy, if you are no longer available to attend the class, please remove yourself from the waitlist online or via the smart phone app. Once you have been confirmed in the class from the wait list, our 12-hour courtesy policy applies, and a cancellation fee will apply if cancelled within this time

Medical Warning
Prior to undertaking any new form of exercise, you should consult with your doctor or other healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you. When participating in our classes, do not overexert yourself and work at your own pace. Stop immediately if you feel pain or discomfort.  You should immediately seek medical attention if there are any unanticipated changes to your physical condition at any time. You must notify your instructor if you have any pre-existing injuries or medical conditions which may impact upon your ability to perform the exercises in our classes.  

Pregnant Clients
We accommodate pregnant clients in all classes unless you are experiencing complications in your pregnancy. If you are new to reformer Pilates, we highly recommend starting with private sessions and/or our Reformer Essentials classes in order to learn the modifications required for pregnancy.

Pregnant clients must provide written clearance from your doctor, women’s health physio or OBGYN to participate in reformer Pilates classes.

16 age and up

For those over 16 years wishing to attend group classes, please contact the studio to discuss your suitability along with parent/guardian consent. A private assessment may be required before attending open level classes at the studio’s discretion to ensure everyone’s safety. Additional private sessions may be advised after the assessment to assist with teaching pelvic floor/abdominal work as well as body awareness for beginner exercises, as this can be quite confusing for teenagers to learn in just one session. We want to ensure that they are understanding and safe to join an open level class especially if they are suffering from an injury like back pain.

CONSEQUENCES OF MISCONDUCT

Dynamic Pilates Studio reserves the right to refuse entry to any person, including members, and have the right to cancel your membership without warning or notice for serious inappropriate behaviour that is threatening or harassing, and includes damaging equipment in the Studio and perceived risks, including but not limited to, the use of illegal or performance enhancing drugs. Warnings for any breach of these Membership Terms and Conditions or failure to comply with Studio and Wellness Centre Rules or acting unreasonably will result in a first warning. Should a second warning be required, then immediate   cancellation of your membership will be made. In the event that any membership Terms and Conditions or  Wellness Centre Rules are not followed where security is called out to the site you will be charged $100.00 to cover the call out fee plus any damages incurred.

PRIVACY STATEMENT AND ACKNOWLEDGEMENT

In the course of establishing a Contract with you and during the term of that Contract we will obtain access to certain sections of your personal information (such as information concerning your health and your financial position). Dynamic Pilates Studio will only use, disclose or deal with such information in accordance with our Privacy Policy.
